The terms governing use of this website and engagement of our services.
These Terms & Conditions ("Terms") govern your use of azimuthmaritime.com and, unless superseded by a signed agreement or our written quotation terms, the provision of services by Azimuth Maritime Solutions ("Azimuth", "we", "us"). By using this website or engaging our services, you accept these Terms.
1. Website use
Content on this website is provided for general information about our services and products. While we strive for accuracy, specifications, availability, approvals and scopes described here are indicative and may change; the scope in our written quotation prevails. You may not misuse the website, attempt unauthorised access, or reproduce content for commercial purposes without permission.
2. Quotations and orders
- Quotations are valid for the period stated on them (default 30 days) and are exclusive of taxes, port passes, boat/launch hire and travel unless stated otherwise.
- Orders are confirmed on written acceptance (email suffices) or issue of a purchase order.
- Attendance windows depend on vessel access, port permissions and weather; we are not liable for delays outside our control.
3. Services and reports
Services are performed by qualified personnel in line with manufacturer recommendations, applicable IMO/SOLAS requirements and good marine practice. Survey findings and service reports reflect the condition of equipment at the time of attendance. Certification is issued only where equipment meets applicable requirements.
4. Equipment supply and warranty
- New equipment carries the manufacturer's warranty. Refurbished or reconditioned equipment carries the warranty stated in the quotation.
- Warranty excludes damage from misuse, water ingress, improper installation by others, power supply faults, or repair attempts by unauthorised persons.
- Title to supplied goods passes on full payment; risk passes on delivery.
5. Client obligations
The client shall arrange safe access to the vessel and equipment, necessary permits and gate passes, a safe working environment, and availability of ship's power and crew assistance where reasonably required. Additional attendance caused by lack of access or readiness may be charged.
6. Payment
Unless agreed otherwise in writing, invoices are payable within the period stated on the invoice. Late payments may attract interest at applicable commercial rates, and we may suspend services or withhold certificates and reports until settlement.
7. Liability
Our aggregate liability for any claim arising out of a service or supply is limited to the value of that service or supply. We are not liable for indirect or consequential losses, including off-hire, loss of profit, delay, or detention. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
8. Intellectual property
All website content, reports, drawings and documentation prepared by Azimuth remain our intellectual property; clients receive a licence to use deliverables for the vessel and purpose for which they were issued.
9. Force majeure
Neither party is liable for failure to perform due to events beyond reasonable control, including weather, port closures, strikes, government action, epidemics or acts of God.
10. Governing law and jurisdiction
These Terms are governed by the laws of India. Courts at Jamnagar, Gujarat shall have exclusive jurisdiction, subject to any arbitration agreement in a signed contract.
